Funhouse Productions (“Vender”), warrants to the original purchaser, (“Purchaser”), that Cool Neon (“Product”) is free from any defects in materials and workmanship, subject to all the terms and conditions hereunder. This warranty is exclusive to Purchaser and is not assignable.
Vender’s sole obligation under this warranty is to replace, or at Vender’s option, to repair, free of charge, all defective parts for a period of 15 days from the date of original purchase. This warranty applies only upon the condition that product has been installed, maintained, and operated under conditions of normal use in accordance with Vender’s recommendations. The provisions of this warranty shall not apply if, in Vender’s judgment, Product has been subject to misuse, damaged in an accident, or repaired or altered in any way that adversely affects its performance or reliability.
To obtain warranty service, Purchaser may, upon the prior written authorization of Vender or its service representative, return the defective product to Vender authorized service center. All shipping and insurance charges are the sole responsibility of Purchaser and are not included in this warranty. In no event shall Vender’s liability exceed the purchase price of the defective product.
This warranty is in lieu of any other warranties, either express or implied, including without limitation any warranties or merchant ability or fitness for a particular purpose or title against infringement, which other warranties are expressly excluded and disclaimed. Vender shall not be liable for loss of profits or any special, incidental, or consequential damages, which Purchaser may sustain. Some states do not allow the exclusion or limitation of incidental or consequential damages so these limitations may now apply to you.
Vender neither assumes nor authorizes any person to assume for it any other liability in connection with product. There are no warranties, which extend beyond the description on the face hereof.
This warranty gives you specific legal rights, and you may also have other rights, which may vary from state to state.
